Terms of Service

1. Agreement to Terms

By booking and using the services of Vallarta Video ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to abide by the above, please do not use this service.

2. Services Offered

Vallarta Video provides professional photography and videography services for real estate properties and vacation rental properties. Our services include:

  • Real estate photography and videography
  • Vacation rental photography and videography
  • Drone photography and videography
  • Video editing and post-production services
  • Additional add-on services as specified in our pricing

3. Booking and Reservations

To book our services, you must complete the booking process through our website or contact us directly. By booking, you confirm that:

  • You are authorized to book the property or services
  • All information provided is accurate and complete
  • You understand and accept these Terms of Service
  • You have read and agree to our Privacy Policy

4. Payment Terms

Payment Structure:

  • A 50% deposit is required to confirm your booking
  • The remaining 50% balance is due upon completion of the shoot before delivery
  • Payment must be received before final deliverables are provided
  • We accept credit cards, bank transfers, and other payment methods as specified
  • All prices are in MXN and do not include IVA unless otherwise specified
  • Applicable taxes and fees will be added to the final invoice

Late Payment: If payment is not received within 7 days of the invoice date, a late fee of 5% per month will be applied. We reserve the right to withhold deliverables until full payment is received.

5. Cancellation and Rescheduling Policy

Cancellations: Cancellations may incur the following fees:

  • Cancellations made 30+ days before the shoot: Full refund
  • Cancellations made 15-29 days before the shoot: 50% refund
  • Cancellations made less than 15 days before the shoot: No refund

Rescheduling: Rescheduling requests are subject to availability. A rescheduling fee of 1,000 MXN may apply if the request is close to the scheduled date. You can reschedule yourself using the booking link if available.

6. Deliverables and Timeline

Delivery Timeline:

  • Photos: Edited and delivered next business day of the shoot
  • Videos: Edited and delivered within 2 business days of the shoot
  • Rush Delivery: Available for an additional 50% fee
  • Delivery is via Google Drive link or other agreed-upon method

Google Drive Links: All files will be provided via Google Drive link. Links will remain active for 3 months from delivery. It is your responsibility to download and backup all files. We are not responsible for lost files after the link expiration date.

7. Intellectual Property and Ownership

Raw Footage and Files:

  • You do not own the raw footage, unedited photos, or original files (unless you purchase them)
  • You own the edited final deliverables provided by Vallarta Video
  • Raw footage remains the property of Vallarta Video
  • You may use the final deliverables for commercial and personal purposes
  • You may not resell or redistribute the final deliverables without written permission

Portfolio Use: We reserve the right to use photos and videos from your shoot in our portfolio, website, and marketing materials unless you explicitly opt out in writing.

8. Revisions and Edits

Included Revisions:

  • Up to 1 round of minor revisions is included in the service
  • We get your approval on the initial deliverables before finalizing, so there's no guessing
  • Minor revisions can include song changes, font size adjustments, color correction, brightness adjustment, and basic cropping
  • Additional revisions will incur a fee of 1,000 MXN per hour
  • Major revisions (re-editing, significant changes) are charged at 1,000 MXN per hour

Revision Requests: All revision requests must be submitted within 3 days of delivery. Requests submitted after this period will be charged as additional services.

9. Liability and Limitations

Vallarta Video is not responsible for:

  • Weather conditions or natural disasters that prevent the shoot
  • Property damage or injuries during the shoot (client is responsible for property access and safety)
  • Lost or corrupted files after delivery (backup your own files)
  • Third-party claims regarding intellectual property or content
  • Technical issues with Google Drive or other delivery platforms

Limitation of Liability: Our liability is limited to the amount paid for the services. In no event shall we be liable for indirect, incidental, or consequential damages.

10. Weather and Rescheduling

In the event of severe weather or unsafe conditions on the scheduled shoot date, we will reschedule the shoot at no additional cost. If rescheduling is not possible, the deposit will be refunded or credited toward a future shoot.

11. Client Responsibilities

The client agrees to:

  • Provide safe access to the property
  • Ensure the property is clean and ready for photography
  • Disclose any hazards or safety concerns
  • Provide necessary permits or permissions for drone flights
  • Not hold Vallarta Video liable for property damage or injuries
  • Ensure all persons in photos/videos have consented to their image being used

12. Drone Operations

For drone photography and videography services:

  • Client is responsible for obtaining any required permits or permissions
  • Vallarta Video holds all necessary drone certifications and insurance
  • Operations will comply with all local, state, and federal regulations
  • Client assumes all liability for drone operations on their property

13. Confidentiality

Vallarta Video agrees to maintain the confidentiality of any sensitive information about your property or business. However, we reserve the right to use photos and videos for portfolio purposes unless explicitly prohibited in writing.

14. Dispute Resolution

Any disputes arising from these Terms of Service shall be resolved through:

  • Good faith negotiation between the parties
  • Mediation if negotiation fails
  • Binding arbitration or litigation as a last resort
  • Governed by the laws of Mexico and the United States as applicable

15. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on our website, and your continued use of our services constitutes acceptance of the updated terms.
